Terms and Conditions

Damara Surf Ltd is a company registered in England and Wales (Company No. 16475481), trading as Damara Surf or Damara Surf Adventures.

These Terms & Conditions govern all bookings and participation in trips, retreats, Surf & Stay packages, surf instructor courses, coaching programs, and related services provided by Damara Surf Ltd. By making a booking, paying a deposit, or participating in any Damara Surf service, you agree to be bound by these Terms & Conditions.

1. Booking & Contract Formation

A booking is confirmed only once you receive written confirmation from us by email. At that point, a binding contract comes into existence between you and Damara Surf Ltd.

Until confirmation is issued, all prices, availability, and trip details are subject to change. We reserve the right to decline any booking at our discretion.

Authority to Book for Others
If you make a booking on behalf of other participants, you confirm that you have their authority to do so. You and all members of your party are jointly and severally liable for all payments and obligations under these Terms & Conditions. We will communicate only with the lead booker regarding all matters related to the trip.

2. Prices & Payment

All prices are stated in euros (€) unless otherwise specified. Flights and international travel to and from the destination are not included unless explicitly stated.

You are responsible for any bank charges, currency conversion fees, or international transfer costs.

Deposit & Payment Terms – Surf Coaching Retreats

  • A 50% deposit per person is required at the time of booking to secure your place.

  • The remaining 50% balance must be paid no later than 45 days before the trip start date.

  • If the balance is not paid by the due date, we reserve the right to cancel your booking and retain the deposit.

  • For bookings made within 45 days of the trip start date, full payment is required immediately.

Deposit & Payment Terms – Surf & Stay / Surf Instructor Courses

  • A 25% deposit per person is required at the time of booking to secure your place.

  • The remaining 75% balance must be paid no later than 30 days before the trip start date.

  • If the balance is not paid by the due date, we reserve the right to cancel your booking and retain the deposit.

  • For bookings made within 30 days of the trip start date, full payment is required immediately.

Deposits are non-refundable except as outlined in the cancellation terms below.

3. Minimum Participation Requirement

Damara Surf Coaching Retreats require a minimum number of participants to operate.

If the minimum number is not reached, we reserve the right to cancel the trip. In this case, you may choose between:

  • A full refund of all payments made to Damara Surf, or

  • A transfer of your payment to an alternative Damara Surf trip, subject to availability.

We will notify you of any cancellation due to insufficient participant numbers no later than 28 days before the scheduled trip start date.

4. Cancellation by You (the Customer)

If you or any member of your booking needs to cancel, you must notify us in writing by email. The date we receive your written notice determines the applicable cancellation terms.

Cancellation Charges:

  • More than 90 days before trip start date: Deposit refunded minus a €200 administration fee per person.

  • 90 days or fewer before trip start date: No refund of any payments made.

These charges reflect costs incurred in securing accommodation, logistics, and third-party services. Refunds due under these Terms & Conditions will be processed within 14 days of cancellation.

We strongly recommend taking out comprehensive travel insurance that covers trip cancellation, curtailment, illness, injury, and unforeseen events.

In exceptional circumstances (for example, government-imposed travel restrictions), we may, at our discretion and acting reasonably, offer the option to transfer payments to a future Damara Surf trip. This is not guaranteed and will be assessed on a case-by-case basis.

5. Cancellation or Changes by Us (Damara Surf)

While we make every effort to operate all trips as planned, we reserve the right to cancel or make changes if necessary due to circumstances beyond our reasonable control, including but not limited to:

  • Insufficient participant numbers

  • Safety concerns

  • Weather conditions

  • Illness, injury, or unavailability of key staff

  • Unforeseen operational or logistical issues

If we cancel your trip, you may choose between:

  • A full refund of all payments made, or

  • A transfer to an alternative Damara Surf trip of comparable value, subject to availability.

Minor itinerary changes (such as accommodation, coaching schedule, or surf location adjustments) do not entitle participants to a refund.

We are not responsible for additional costs incurred by you (such as flights, insurance, or visa fees), and we strongly advise that you have appropriate travel insurance in place.

Refunds due under these Terms & Conditions will be processed within 14 days of cancellation.

6. Travel Documents

You are solely responsible for ensuring you hold a valid passport (minimum six months’ validity beyond travel dates) and any required visas or permits. Damara Surf Ltd is not responsible for denied entry, delays, or disruptions due to incomplete or incorrect documentation.

7. Travel Insurance

Valid travel insurance is mandatory for all participants. Your policy must cover:

  • Surfing and water sports

  • Medical treatment and evacuation

  • Trip cancellation and curtailment

  • Theft and personal belongings

Participation will be refused if adequate insurance is not in place, and no refund will be issued in such cases.

8. Health, Fitness & Assumption of Risk

By joining a Damara Surf trip, you confirm that you are medically fit and capable of participating in physically demanding surf activities. You must disclose any relevant medical conditions prior to travel.

Surfing and adventure travel involve inherent risks. By participating, you voluntarily accept these risks and acknowledge that Damara Surf Ltd is not liable for injuries, illness, or losses arising from activities conducted responsibly and in good faith.

9. Conduct & Removal from Trips

Guests are expected to behave respectfully and responsibly. If your conduct is deemed unsafe, disruptive, or harmful to others, we reserve the right to remove you from the trip with no refund.

10. Media & Image Use

By participating in a Damara Surf trip, you consent to being photographed or filmed for promotional purposes. If you do not wish to appear in any media, you must notify us in writing before the trip begins.

11. Force Majeure

We are not liable for delays, cancellations, or changes caused by events beyond our reasonable control, including but not limited to natural disasters, pandemics, political unrest, airline disruptions, or government restrictions.

12. Liability & Indemnity

To the fullest extent permitted by law, Damara Surf Ltd shall not be liable for loss, injury, illness, or damage unless caused by proven negligence. You agree to indemnify Damara Surf Ltd against claims arising from your actions or behaviour during the trip.

Third-Party Services Disclaimer
Some services included in your trip, such as accommodation, transport, or local guides, are provided by third parties. Damara Surf Ltd acts only as an organiser and is not responsible for the failure, negligence, or breach of contract of any third-party supplier, except as required by law.

13. Complaints Procedure

If you have a concern during your trip, please raise it immediately with your guide or a Damara Surf representative. Complaints reported only after the trip may not be fully investigated or may limit our ability to provide compensation.

14. Governing Law

These Terms & Conditions are governed by the laws of England and Wales, and any disputes shall be resolved exclusively in that jurisdiction.
